Writing a Will is sometimes considered a taboo subject, but it shouldn’t be! While none of us want to think too much about the particulars of what happens when we die, passing away without a valid Will can result in a great deal of uncertainty and stress for your family – not to mention potential costs associated with dying intestate.

Dying intestate, means that you do not have a Will and therefore the law will decide who should rightfully inherit the deceased persons estate. This may not necessarily be the person, or people that you would have chosen and it can often result in unnecessary family conflict long after you have gone.

Common problems that occur when a person dies without a Will, include long-term partners, whom the deceased person would have considered their spouse in all but name is not entitled to any share of their partners assets.

We have even seen a case where a gentleman passed away unexpectedly, and despite living with his current partner for over two decades remained lawfully wed to his first wife of whom he had not been in contact with for almost thirty years! As the gentleman passed away without a Will, neither his partner or his children were first in line to inherit his estate but rather his first wife. Understandably, this caused a great deal of anguish for the surviving family members.

Do I need a Will if I have no assets?

This is a question we get asked a lot – many people believe that if they do not own a property or have savings, that there is little point in writing a Will. But this is not true!

There are considerations to be made with regard to the care of children, your personal possessions and the arrangements made for your funeral. You may even have a beloved pet that you want to entrust to a particular person.
